CLARIFICATION TEXT ON PROTECTION AND PROCESSING OF PERSONAL DATA
This clarification text was issued by Özak Yenigün Ziylan Adi Ortaklığı (the “Company”) as the data controller pursuant to the Law no. 6698 on the Protection of Personal Data (the “Law”), Article 10 as well as the Communique on Procedures and Principles for the Performance of Clarification Obligation. The Company may process your personal data in compliance with the Law for the purposes as described below.

Which Personal Data Are Processed?
Name, last name, mobile phone number, e-mail address, date of birth, name of the company employed, personal identification details, address, country, completed forms in addition to photos, recorded video calls, and video footage transferred within the scope of contests as well as any other kinds of Personal Data that you have shared with us.
What Are the Intended Purposes and Legal Basis for Processing of Personal Data?
Your personal data may be processed for the purposes of ensuring the performance of our services to be provided in line with the provisions of the relevant agreements and technological requirements, providing after-sale support services relating to the products and services, carrying out customer relationship procedures, addressing your requests and complaints, ensuring that the relevant business units perform necessary operations in order to carry out business operations as maintained by the Company, and maintaining the relevant business processes thereof within the scope of the conditions for processing of the personal data as defined in articles 5 and 6 of the Law thereof. 
Subject to your explicit consent, your personal data may also be processed for the purposes of development of our products and services, carrying out our marketing activities, providing you with information on our campaigns, sending commercial e-mails on advertisements, promotions, etc. and transferring such personal data to our service providers to ensure the transmission of such messages, ensuring the provision of more relevant services to you based on your needs by learning more about you, using your photos taken during providing you with our services, carrying out marketing surveys, customizing our products based on your requests as well as for the purpose of profiling thereof.
For Which Purposes Personal Data Are Transferred?
Your personal data collected may be transferred for the aforesaid purposes to our group companies, namely, Özak Gayrimenkul Yatırım Ortaklığı A.Ş., Yenigün İnşaat Sanayi ve Ticaret A.Ş., Ziylan Gayrimenkul Yatırım ve Yönetim A.Ş., Özak Global Holding A.Ş., Aktay Otel İşletmeleri A.Ş., Akyön Tesis Yönetimi A.Ş., Kamer İnşaat Ticaret ve Sanayii A.Ş., Akyön Özel Güvenlik ve Koruma Hizmetleri A.Ş., İnt-Er Yapı İnşaat Turizm San. ve Tic. A.Ş. as well as our main shareholders, affiliated companies, group companies, subsidiaries, service providers providing us with the necessary support to ensure provision of the services to you, our business associates, vendors, suppliers, legally authorized public institutions, service providers, domestic and foreign servers, domestic and foreign cloud service providers, relevant natural persons and legal entities processing such personal data on behalf of the data controller and/or providing support for measurement, targeting, profiling on behalf of the data controller, audit firms, advertisement, and promotion agencies, and private persons within the scope of the conditions for processing of personal data as defined in articles 8 and 9 of the Law thereof.
Your personal data may be transferred to domestic/foreign servers as well as domestic/foreign cloud service providers subject to your explicit consent as per Article 9 of the Law thereof.
What Are the Methods for Collection of Personal Data and the Legal Basis?
Your personal data may be collected by any means as you contact our Company either online through our website, call center, online applications, cookies, electronic mails, social media platforms, search engines, or physically through our vendors, sales and marketing department staff, printed forms, subscription forms, and solution partners on the legal basis for the performance of the relevant agreements thereof.
Subject to your explicit consent, your personal data may also be processed within the scope of the conditions for processing of the personal data as defined in articles 5 and 6 of the Law on the legal basis for providing you with the products and services by customization based on your interests and using habits.
What Are Your Rights As the Owner of Personal Data?
As the owner of personal data, we hereby inform you that you have the following rights pursuant to article 11 of the Law:
a) Inquiring whether your personal data are processed or not; b) Requesting for information if your personal data have been processed; c) Learning about the purpose for processing of such personal data and whether such personal data are used in line with the intended purposes thereof; d) Learning about domestic or foreign third persons to which such personal data are transferred; e) Requesting for correction of the personal data in case such personal data are processed in an incomplete or inaccurate manner; f) Requesting for deletion or disposal of the personal data in line with the conditions as defined in article 7; g) Requesting for notification of the processes carried out as defined in items (e) and (f) to the third parties to whom such personal data are transferred; h) Raising an objection to any outcome against the personal data owner in case such personal data are processed exclusively by automatic systems; and i) Requesting for compensation of damages in case of any damages incurred by the personal data owner due to unlawful processing of such personal data thereof.
You can submit your applications for exercising your rights as defined above after completing the Application Form available on www.buyukyali.com and by submission of this form to our registered office by visiting and showing your ID in person, or through a notary, or by sending an electronic mail to the Company's registered e-mail address by signing the form with your secure electronic signature, or by sending an electronic mail to us via the e-mail address as previously notified to us and registered in our system. Based on the nature of your request, your applications will be finalized free of charge as soon as possible and within thirty days at the latest. However, you may be charged a fee based on the tariff to be determined by the Committee on the Protection of Personal Data in case the process subject to your request requires any additional cost thereof.
